Rep Power: 0 | | Apartment Trouble I moved into an apartment complex on March 21 of 06 my fiancé also moved into the apartment with me. On entering that day the lady at the front desk by the name of Kristen leased me to a 7 month lease that I signed for and paid the amount that was needed up front. I had also gone over the lease with her and when asked about my seven months I told her we wouldn’t be staying after the lease was up. She then told me that the apartment had not been painted or re carpeted because we needed an apartment fast and she said they didn’t have time to re do it. She told us to make a list of the stains on the carpet and walls and then she would have someone come clean the carpet and fix the walls for us. So the exact day we moved in we did just that and made her a list. Took it back to the office and gave it to her where she put it in our file and said that she would get a work order right on it. No one ever came to the apartment to fix the carpet and walls and we waited for a couple weeks. So we went back to office because we still hadn’t received our washer and dryer that we were supposed to have. She said she totally forgot about it and that there was a shortage and we would have to wait till one was available and we were on top of the list. She then said she would put a work order out for the washer and dryer and would let us know when one was up. Finally she said they had a set in storage about a month later. To then call me the next day and asked if I went and got the washer and dryer out of storage myself. When I told her no I was waiting on them to bring it to me she then told me that it had been stolen. Four months had went by until finally my neighbors moved out across form me and I had to run up to the office and tell her I wanted that washer and dryer and if I had to move it myself I would. She had someone come and transport it the next day and all was well.
I then found sometime later that Kristen no longer worked there and there was a new office lady. Through the months to follow, I had a noise problem from the neighbor downstairs and when I called office to complain nothing was ever done about it and my phone calls were never returned. So I gave up on that and finally decided to start packing to leave. A month before October which was my last month I went to Teresa and asked about my last day and that I was moving and what I needed to do. She told me that all was ok and wished me well with the move. A week before October 31st I reminded her that I was moving and she told me that since I didn’t put in a 60 day written notice that I would be penalized. I told her that I had mentioned me moving a month before and she told me that I didn’t put it in writing and that it was my problem. She then changed her story and said that she would have to get with her boss Sheila to make sure and I told her to call me when she found out. She never called me so I went back up there and she told me all was ok and that I didn’t owe anything else. So I made the Monday the 30th the walkthrough date with Teresa so they could come examine the apartment before I moved out. No one ever showed up on Monday and I was home all day. So I began to move out and a week after I move I called Teresa up and arranged to pay my last water bill. I went up there on that Friday and asked her if I owed anything else and she said no I was good and wished me luck again with life. So to my surprise when I called up there about a referral check that I was due for referring my brother to their apartment. Sheila answers and begins to tell me I am a skip out and I owe her two months of rent. I ask how she came to that conclusion and she said that I didn’t give a 60 day notice to move out, I said my lease was up and she said it didn’t matter that I still needed a 60 day notice because if I don’t then they will go ahead and renew my contract and it was all black and white in my contract.
I asked how they could do that legally if I didn’t sign a new contract and she couldn’t answer me. She then said she would be taking me to court if I didn’t pay. Then she said but to keep it out of the court she could get me to sign a 30 day notice and only pay a month of rent. I told her that if in fact I owed anything then she could take my deposit and put it towards the money and my referral check as well. She said she couldn’t do the referral check because corporate wouldn’t allow it and that my records stated I didn’t pay a deposit. I knew I had paid a deposit so I had to get the bank to send me my bank statements and then had to get the copy of the check to prove it. I also explained to her that Kristen told me that the only reason I needed a 60 days notice was if I was breaking my lease and I didn’t my lease was up. She said that Kristen would never say that and pretty much called me a lire. Then I explained that Teresa told me a few days before that I didn’t owe a thing and I was all caught up. She stated that she didn’t know how Teresa came to that conclusion and that I did owe and she would have a talk with Teresa. So now Here I am being threatened with court if I don’t pay money that I do not think I owe, Due to the lack of interest when it came to the needs that I had as a tenant, them taking 4 months to get me a washer and dryer. Also not cleaning the carpet and walls when it was promised, not doing a walkthrough at the end and then saying I didn’t even pay a deposit. They still haven’t cleared my check for the water bill and it had been almost a month singe I gave Teresa the check. Teresa had told me she was new and didn’t know anything, in my opinion that is not an excuse and one should not hire incompetent staff to run an apartment complex.
