Exclamation Landlord Troubles

I need some help.
I have had trouble with my landlord from the word go. He tries to let himself in without giving 24 hurs notice, Also we where late on rent so he gave us a months notice but we started paying rent again. Now there has been a leak and the cielling fell in and now he is trying to have us out tommorow. is he allowed to do that? Or does he have to give another months notice? And what action can i take to stop myself becoming homeless. P.s i am also pregnant.

Please help!

Lori. xxx

Default My Factual Opinion

Hi, Don't know if anyone has helped you yet but here's my advice, I am a landlord in Ohio and I know that your landlord cannot come into your residence under any circumstances unless it is A. An emergency or B. He has given you proper notice by verbal or written form for his use or maintenance issues. If he gave you a month's notice he has right to evict you from the property BUT he cannot evict you if he did in fact take your rent after he gave you the month's notice. You can fight that in court. The ceiling issue, if it a major problem which it sounds like it is you need to go to your local courthouse find out which office takes care of cases with escrow, escrow means when something happens in your rental and the landlord does not fix it within a few days of happening, the court will put your rent in escrow and the landlord does not get paid until he fixes the problem, you will not be evicted and he will be in trouble with the court until he fixes this problem. If he does deny your rent then he can evict you and a court date follows within 30 days, In this situation I strongly suggest you go to court, take pictures of your ceiling and document everytime he tries to force his way into your rental and fight him tooth and nail in court and the judge will see it your way, done this a million times. Good luck.
