Rep Power: 0 | | Structured Settlement..Where is it? My daughter was bitten by a dog 11 yrs ago. Long story short...the defendants wanted to settle out of court and made an offer for a structured settlement with no responsibility for any future damages she suffers from the bite. I didn't agree with the terms and told my atty that. He calls me a couple of days later and tells me that if i don't sign the agreement, that i will be held in contempt of court. It scared me and i signed, still not agreeing...later to find out that he probably just didn't want to go to trial.
Not too long ago i learned that the money in a structured settlement is put into an account, like an annuuity, and gains interest. I have contacted the atty numerous times to find out this information and he never gets back to me or gives me any information. I have no idea where the money is, i was also told that i am suppose to be getting statements on this money.
Please advise me as i feel he misreprested me and made me sign something i didn't agree to and now where is the money? What should or can i do about this? |

Rep Power: 3 | | Your are correct - the structured settlement should be in the form of an annuity, and there should be some indictation of who holds the money.
I question everything about what your lawyer told you, including the nature and terms of the settlement. Consider finding a lawyer who handles legal malpractice cases and having him figure out what happened (and whether there is a case against your lawyer) or filing a grievance with the state bar. | | Domain Names Sponsor | | |
