Rep Power: 0 | | Pure Comparative Negligence, California Jurisdiction Negligence i was involved in a car accident a couple months back. I was the 4th car in a 5 car collison. The 3 cars in front have settled. The 5th car, which hit me, refuses to compensate for personal injuries. THey are willing to compensate for the damages to the car (which is totalled).
Now the question is...
THis is a california jurisdiction. THe law is pure comparative negligence. The insruance who refuses to compensate for personal injuries claim that I was negligent myself and therefore they will not compensate.
I know i have the right to at least some compensation for damages whether its 5% to 51%. Here is the question. How do I file a complaint. I know all the civil procedure rules, but this is a california state court. abeit small claims court. Do i need an attorney with me? Can i represent myself? How do i write the complaint?
my insurance are dip****s....they are paying only for the people in front of me...they aren't even helping me reclaim my damages. I have not received one cent from the person behind me. My insurance had to pay for all the damages to my car. My insurance sucks. Its AAA
WHen the chiropractor called my insurance, they said "we are not covering for personal injuries" then my chiropractor called the insurance of the person who hit me...they said "we will not compensate because bracer was negligent first and caused the injuries to himself"
seriously i think i need to write a letter first then send a complaint through small claims court... |

I think you should check out Pre-Paid Legal, they would repersent you in court up to 75hrs a year, with unlimited phone calls and letters on your behalf, and document review just about everything you need check them out it might help alot. Less than 30$ a month f
