Rep Power: 0 | | URGENT! Please help me! I don't know what to do Hi Guys, I am from Colorado and this is what happened yesterday. At a ski resort, a lady and my wife got into a fight (apparently my wife got on her way while skiing), the lady started to get very violent at my wife, who knows martial arts and pushed her. The lady fell, my wife kicked snow at her and I had to get between both to stop it.
The lady called the cops, they filed a report and called my wife to the police station tomorrow morning to talk to her about that. She already gave her statement yesterday, so it seems like they called her to clarify a couple of things, since her side of the story is different than the lady's.
My questions are:
1) What are my wife's rights at the interrogation session? Does she have to answer the questions? Should she go there with a lawyer?
2) What is the worst that could happen here? From my point of view, there was no need to get the cops involved as it was a minor problem, but I don't know how deep in trouble is my wife in.
I would really appreciate some input here, since this never happened before and we are a little bit scared.

Rep Power: 0 | | Re: URGENT! Please help me! I don't know what to do I am not a lawyer but i do know for a fact if she is not getting arrested she can walk out of the interview at any time. She does not have to talk or answer any of the police questions. And she can turn around and press charges back on this lady. With both charges it will probably get thrown out.
About the push if your wife felt threatened, like she felt she was in immediate harm from this lady. She was being attacked and didn't know what else this lady would do. To get out of the situation and protect herself she had to use a small amount of force. But stopped at that. My suggestion is to get a lawyer and have the lady pay for a lawyer fees and court fees. Well good luck. And make sure you pick a good lawyer who is willing to fight for you not just your dollars.

Rep Power: 0 | | Re: URGENT! Please help me! I don't know what to do Your wife should cooperate. She is not under arrest. The Cops are just trying to find out all the facts. At worst, this is a civil action. I do find it intersting that the Cops want more informnation from your wife.
As I see it, this other person filed a criminal complaint. At this point, the cops are just trying to staighten it out.
Should your wife be detained tomorrow longer than let's say 20 minutes, I would not answer any further questions and demand coucil

Thank you!! | You have no rights unless you have an attorney to tell you your rights! How convenient and wonderful to have access to a firm that is even on call after hours if an emergency comes up and you need an attorney. How many people have that kind of service and even know about it? It is good to have an attorney available at all times. Yes this sort of thing does exist! So my suggestion is to contact me to get the info you need.
