Default IRS Tax Preparer Mistake

Well here is my story for now. Basically..my dad went into a tax specialist and had his taxes done professionally. What happened was that the tax pro let my dad claim me as a dependent. Now a few facts you should know that I found out through the IRS.GOV website. As 5 types of criteria that must be met for him to claim me, two were not.

FIRST I am his child BUT i am 20 years old and i WAS NOT a fulltime student for the whole year last year. Therefore..i COULD NOT be claimed by him, because 2 of the criteria were NOT met.

So in all this junk..my tax refund has been messed up because my dad has "claimed" me. We spoke to the IRS on the phone and they said that they could fix it BUT it wont be happening for 8-12wks. I also spoke with the preparer yet he says everything he had done was correct but according to the IRS it was not. Therefore, my concern is that I have school to pay for now along with many other bills and I needed that money in my hands for this month. Now normally without the tax pro messing up as they did and not only messing up my return but causing my father problems, I will not have the money I very much need. SO I was wondering if there was any way of us to sue him (tax pro) or to somehow get money that we need now through him for being the one who messed up everything.

Or any legal advice that we could do with him would be great because im very angry over this whole ordeal.
