Rep Power: 0 | | divorce + garnishment I live in the state of Washington, a community property state. After our seperation, my (soon to be) exwife purchased a car. At the time that our seperation was supposedly temporary while we worked out our issues. As a show of faith in our future together, I signed my name to the auto loan. Of course I realize the folly in this now, but here is the problem I am left with: I am currently having my paycheck garnished weekly for a car I never had posession of, and which has now been reposessed. The debt is listed specifically in the dissolution of marriage papers which have been filed with the court, and which have been served to my exwife, but the divorce is not yet final. At what point are the garnishers required to stop taking money from my pay? I realize the garnishment may resume if my exwife files a bankruptcy down the road, but I have already accepted that I will have to bankrupt at that point also due to the massive amount of debt she accrued during our marriage and our seperation. I am concerned only with the immediate matter of the garnishment, as I have custody of both children born in the marriage and only occasionally get a small bit of child support. | | Domain Names Sponsor | | |
