My ex husband and i have always remained friends from the get go through our divorce, we NEVER adhered to the divorce decree because it states that as long as we AGREE we can change things verbally. 6 months after we divorced he was re-married to a woman I am sure he was cheating on me with but i didn't care as long as we stayed friends for our son's sake. 2 years later I re-married a wonderful man who not only takes care of me but my other 2 children that were not my ex-husbands. We were married nearly a month when the company he worked with for 8 years went bankrupt and we lost our ONLY source of income because i was in school at the time trying to get a degree for a better career, we had just moved into a new house and now we had no income! My husband had a few job offers but he works in the special effects and animation industry and there wasn't much of a job market for that in Tampa and we would have taken a significant pay cut, i had a brand new car and we had student loans etc to pay off, anyway long story short my husband got a job offer in California making WAY more money in Hollywood and it seemed like a great opportunity. I spoke to my ex and we verbally agreed that i would leave our son with him for the summer and my older 2 kids with my parents until we were settled. He wasn't happy we were leaving but he understood and said it was ok. Well here we are almost 4 months later and it took us a little longer to get a home here in Cali due to the market so i gave my ex the ok to let our son start school there so he wouldn't be behind. We planned on him coming in November on his school break and i told my ex i would wait to tell the courts i moved so our son could go to school 1/2 the year and we wouldn't have to pull him out and also neither of us really had the money to pay for court costs. This is how we ALWAYS operated we always did word of mouth and agreed on EVERYTHING, then something happened w/him and his wife and it seemed to have something to do with me (we always talked on the phone almost everyday) then suddenly he only wanted to talk thru e-mail, asked me not to talk to him about anything personel etc etc I was confused si i confronted him and we had a big argument and he told me he wasn't going to let me have our son and that his attorney told him i broke the rules leaving and our papers are null and void! I have 50/50 with my residence primary, and i have rights to see my son! Can he do this? Isn't he in essence kidnapping him? I have been back and forth to visit my son and i don't OFFICIALLY hav residency in Cali, I still have my vehicle and insurance registered there and i haven't gotten my license here yet either. My 2 older children are in school here now and they can't leave in November to go to Florida to see their brother! What can i do? (sorry this is soo long but i have to tell the whole story)
