I was granted an Order of Protection against my husband. We are currently going through a divorce and my oldest child, age 11, told me that he was molesting her. She said she felt safe to tell me since she knew that her step-father would NOT be coming back into the picture. Well, here is the problem, my husband is trying the get the Oder of Protection, taken off of him and I have to go to court on Monday. How do I win to keep the Oder of Protection on him???????? HELP!!!!!!! |

Well, the most important thing to do is to make sure you show up at court on Monday, because your voice will be heard. The order is much much more likely to be vacated if you are not there. Unless you appear or deliver a written statement that you are still in fear of harm, they could assume the matter has blown over. Appear, state your claim to either the court mediator or the ADA and I feel pretty confident that the order will stand.
