Child support agency Contempt of courtDecember 10th 2007 in a medina county court room, it was agreed bewtween myself and my exwife that I would waive the Unreimbursed medical expenses that she owed me in exchange for Her waiving the Child support arrearages that I owed her.
I only owed back child support in the amount of $739.39 , she owed me approx. $1,000.00 in un-reimbursed medical expenses that she never paid.
There is no current order to collect current child support as of July 27th 2007, my son turned 18 years old and no longer attends school and works full time , he is emancipated , the only money that was being collected was for a couple of months of back child support that I owed my exwife and she waived that amount in court on December 10th 2007.
As of December 10th 2007, I no longer owed any money to my exwife for child support.
I owed her Zero.
I was the Plaintiff , she was the defendant.
I dropped my case for the unreimbursed medical expenses in exchange for the defendant ( My ex-wife) waiving the back child support I owed her.
We both agreed and was happy with the end result.
a Judgment entry was issued and signed by the Judge and sent to myself, my exwife and to the child support enforcement agency.
The judgment entry clearly states that the Child support enforcement agency was to adjust their records to show that the back child suport I owed was waived by my exwife in exchange for me waiving the unreimbursed medical expenses. ( It Is So Ordered ) and that I no longer owed any money to my exwife.
The child support enforcement agency refuses to acknowledge that portion of the Judgment entry and refuses to stop taking child support out of my paycheck, no matter what I do.
At this point in time, since Decemebr 10th 2007, they have collected MORE than I originally owed my exwife ( $739.39) , and they still refuse to stop taking the money out of my paycheck.
These people are compleytely out of control and need to be stopped.
I have called them and spoke to different people at the support enforcement agency numerous times and pointed out ot them that they are making a mistake and going against the Judgment Entry that was issuedand have gotten nowhere with them all I get is an argument and a hang up.
This has caused a huge Undue Financial hardship on myself and my family and has created an enormous amount of stress not only on our finances but on our marital relationship and the relationship with our children and has created problems that we can not provide the necesary items that we need to supply for our family.and also a direct illness over the stress related to the financial hardship and emotional and mental distress from the direct viloation of the judgment entry that the child support enforcement agency refuses to follow.
I have to go in to the doctors on Monday to get checked for an Ulcer that they think is caused from my stress.
This is great, I am Legally being Stolen from and getting an Ulcer over it in the mean time.
I want to sue them for all this trouble and undue situation that me and my family are in because of their neglect of duty to perform their job responsibilities in a timely and responsible and legal manner.
My family and I are suffering over this and I want them to be held responsible for this problem. I have sent emails to the Magistrate and Judge that precided over the hearing and told them what is happening, but I have not gotten a response from them as of yet. Please somebody help us, I am ready to loose everything I have and maybe even my family over this..
