Rep Power: 0 | | Decree of Divorce not issued Hi,
My New York divorce trial ended in May 2007, now is November and the judge still hasn't signed a divorce decree.
In the meantime the judge issued "Decision and order" (August 2008) ordering me to hand over the last remains of my savings ($26000) to my wife's attorneys and as a compensation to my ex, $3000 monthly support (she, just like me didn't get a single dollar from my $80 000 cash and equivalents in the bank that we started the divorce with).
My wife's attorney and her partner happened to be one of the contributors to the judge Robert Neary failed 2004 election campaign.
I think judge Neary does not issue a Divorce Decree simply because he is afraid that during the appeal corruption will be revealed (after Robert Neary refused to recuse I withdrew my divorce claim, but the judge insisted to proceed on a counterclaim that wasn' served to me; the counterclaim was faxed to my lawyers just two days before the trial - frappant violation of NY CPLR which requeries 60 days period before the trial).
Is there any time limitation in which a Divorce Decree must be issued? What my options are? - can the judge being forced to either sign a divorce decree or dismiss the matter?
Thanks,
Peter www.neuronica.com
