Default Question on marriage - legal or not?

My husband and I have been in custody battles with his ex for a few years. We finally won custody of my step daughter and as limited visitation as our state would allow. (Her mother is quite unhealthy and lives with many different men on and off, moves around a lot....has two other children with two different men that were not legal here and are back in Mexico now, just to give a background.) One of the stipulations that we made sure to include in the revised parenting plan was that she could not have any overnights if there was a member of the opposite sex there, unless they were married. This would ensure that my step daughter is safe. (I just think of what kind of men would shack up with a dumpy mom with two illigitimate children and no job...you hear of child molesters being drawn to that situation) Anyway, she has been living with a man from Mexico (not legal - but does have a social security number obtained from his brother) and now says she has married him. I'm wondering what is needed in a legal marriage and also, is it considered legal if he is not a legal citizen here? We really do not want her to have overnight visitation because this man is another fly by night like the rest of them.

Any information would be helpful.

There is a department of each state which issues and holds on record marriage certificates. It sounds like the first thing you would need to do is prove the marriage is not legal by finding out if a marriage certificate was issued. Than, if you find out that she is not married, you could return her to court and she would be in violation of the judges stipulation for overnight guests.

Legal advice must be given to the couples before marriage and they must agree with each other to marry each other.
