YouTube.com and cover music - Court Forum

Hi, I have a question about youtube.com and uploading a cover version of a song without permission. by this i mean me video taping me playing the guitar and singing a song say for example folsom prison blues by johnny cash.

i have read the Copyright Act and If I am understanding it correctly Title 17 secton 107 "fair use" is a grey area at best. but it does say fair use includes this "for purposes such as criticism, comment".

now with that being said if i record myself singing a cover song and am uploading it to youtube.com for non profit, commenting and critique then this should be legal if i am understanding the law correctly. i have also included this disclaimer in my description of the uploaded song as stated below.

"This cover tune was posted as a tribute and for non profit purposes only under the Copyright act Title 17 Section 107 "Fair Use" and is soley intended for personal critique and comments on my musical ability."

So what do you think? Is this legal? Or not?
