Default Website Purchase - Sued for a chargeback?

I recently purchased a website for $3,000 which the owner said had generated about ~$700 a month income from adsense and paypal. However I get the website and it's generating like $30 a month...I'm obviously upset and tell the owner I want to push the domain back or else I will do a chargeback as the website has been misrepresented. They said the sale was final and they never guaranteed the website would make that much money. They said they will be filing a lawsuit against me and a summons if I do the chargeback.

(I bought the site through a forum and the sales letter never stated the sale was final and also did not guarantee that it would make that much money...however the owner posted screen shots of revenue and suggested it could continue to make this much money)


Do they have a case? Not sure what I should do as I do not really have money for my own lawyer

Are you in the same state as the seller, or a different state?

Can you document from the ads that the seller in fact promised certain earnings, or represented an earnings history that was false?

I am in a different state than the seller. The seller lives in New York. I can document that he said the site was earning $700 a month. So far I filed a charge back and have received my money..but the person said he will be taking me to court. Not sure if he is just trying to scare me? I think it would be very expensive for him to do that don't you?

I really doubt the seller will follow through with his claim.... Did you push the domain back yet? You should probably do that since you did get your money back....

That is one good thing about using a credit card to purchase sites.. Last case senario you can do a charge back......

I would just print out his screen shots, sales letter, and revenue stats, and just put it on the back burner.... I doubt they are coming after you....
