Rep Power: 0 | | Owner liability Pls Adv: Uninsured drunk driver with revoked registration totalled my '90 Dodge Dakota in front of my house. Left keys in car and ran from scene. Only witness saw "blonde woman running from scene" - couldn't positively ID. Police found vehicle owner at home on second attempt (drunk blonde woman). Asked her where her keys were- she said purse, they said no. She said she wasn't driving and they couldn't prove otherwise. No blonde teenagers in household. Follow-up 2 days later by investgating officer - she says remembers leaving keys in car and wants to file stolen vehicle report. My insurance (liability-no prop damage) doesn't cover and truck is not drivable. I've started paperwork to sue. My belief - she was the driver. My position - her negligence (leaving keys in car w/revoked reg, no insp, no ins) makes her liable because keys shouldn't have been in car in the first place and plates should have been surrendered to DOT. Also advised by police that there is an associated incident report but I must supoena it and/or officer to get details. Clerk of Court also advised I may get judgement but to recoup loss may have to file additional papers for personal property attachment (in the company of 2 officers).
