Rep Power: 0 | |  Help! Illinois Trooper Charge Me With DUI Even After I blew below .08
I need help with this most unusual situation. Coming back home from St. Louis, I get pulled over by an Illinois State Trooper. He gives me three sobriety field checks even after I told him I had three beers five hours earlier, one before supper, one while at supper, and one before we went into the ballgame. He said I failed the sobriety checks and places me under arrest for DUI. At the County Jail, I blow a .017, or approx. .063 below the .08 benchmark. I ask that I now be released. He says no the DUI charge stands and proceeds to write me two more tickets, one for crossing the center line and another for speeding, which I was not informed of earlier.
I have no priors, and my last ticket was 16 years ago. What did I do wrong to cause this?
What recourse do I have? This trooper is causing me to spend money on a towing bill for my car, processing fee at the jail, and to get an attorney. What are my options? I feel like I have been wronged in this situation. I know State Troopers in Illinois have discretion if they feel you were impaired, but I feel this a little extreme.
