Rep Power: 4 | | Witness protection I guess the issue of threats from people against whom you lead evidence, and their associates, is a prime concern. How can we ensure protection in such cases? What is the correct form of action and precautions that one should take? I am particularly concerned about child molestation cases.  |

She won heart-warming public support and thankfully has not been harmed. |

Rep Power: 0 | | Re: Charges against other people i live here in texas and i have recently discovered that my ex lied in court about a conviction of domestic violence she accused me of in 02. i wanted to take it to jury trial,so i could have her testify against me and discredit everything she lied about in that instant. instead she went to the d.a.'s office and after i took a class and the charge was dismissed. my question is. why is perjury and false statements embraced so freely in family courts? also since i have the necessary documentation, how do i start to proceed in filing either perjury charges or aggravated perjury charges on her? i've called the da's office and all those hillbillies do is give me the run around. do i start with the cops? i haven't spoken with anyone who seems to be willing to bring a lying contemptuous female to "justice" i'd appreciate any feedback anyone has. |

His ex didn't show up in court and the judge dismissed the case; however, the State took it up. She had taken out a stay away order against him and then called me, his brother, and some of his friends to come get his belongings off the car- port. She said she had dropped the stay away order. When my son went to get his belongings he sat in the car and was writing her a letter. The cops showed up and he was arrested for the above charges. We paid an attorney $4500.00 but he can't seem to get the charges dropped since his ex lied to everyone about the stay away order being dropped. His attorney has had a stroke and is not the sharpest knife in the drawer. We don't know what to do. Any suggestions? |

I'm not an Attorney but, How many people actually heard her state that the order of protection was not an active order? And are they willing to sign sworn affidavits to the court and/or testify? Most attorney's i have had dealings with do not wish to take a case to jury trial. That also includes the DA's office here in Fort Worth Tx. Your best bet would be to Take it to Jury trial and do alot of the legwork yourself rather than being dependant on an attorney to do it for you. However, did he recieve a copy of the order from a law enforcement officer or court official? because if he did not get a copy of the terms of the order is not a valid protection order. get a copy of it. His signature should be present on it. If the Attorney is not physically or mentally competent he should not be representing you at all. Your son has final say in all of it. A LOT OF ATTORNEY'S ASSUME that the average person off of the street knows the process of the "legal' system. In most courts i've been in the law flucuates Vastly. request a copy of the hours the Attorney has spent on the case and tell him of your lack of confidence in him due to his medical condition. he "should" not hesitate to give you the unused portion of the money back. that doesn't mean he will not. look at the contract you signed with him and if he gives you too much grief,well, more than he has already. contact the state bar association.There is a grievance process. Do the homework on filing an effective complaint. USE the grievance system mainly because unethical Attorneys hate that, because then they have to answer to someone for their conduct. there are 2 attorneys that my mom and i have grieved and they are currently being investigated by the bar. Be thorough and provide documentation of everything. Most everything attorney's do is for their own benefit and not their responsibilty to diligently represent the client.it's called Cover your ass. Discredit the girlfriend as much as you can by documenting her lies. you really cannot record phone conversations due to federal wiretapping statutes. Inadmissable , constitutional right to a reasonable expectation of privacy.
keep records of everything, do a criminal background (felony) check through the district clerks office and county clerks office for misdemeanors.it's all open records,public information. the point is.this is all a game to her. don't play it. get the representation you need and take it to a jury trial.10 to 1 odds she won't even show up for court. so make sure she is subpeonaed. Good luck i hope this helps some. make phone calls to the local bar association for help.. You'll be surprised that there are really some ethical people in the legal system.you just have to look . do not cop a plea. jury trial. force that issue. |

We do have people who will testify that my son's now ex-wife lied about the stay away order being lifted. I am one of those people. She called me and con- vinced me of it and I, in turn, convinced my son. Therefore, I feel responsible for this to some degree.
