Rep Power: 0 | | Sold a car and buyer wont pay One year and seven months ago, we sold our car to a family friend. We wrote up a contract and had her sign it along with us and a witness. We gave her a year to pay us the $1200.00. Being over a year and a half later, she has only paid $400 and does not intend on paying us any more. There isn't actually any way that we can prove she paid us at all. She paid in cash and did not request a reciept or anything. What options do we have? Would it stand a chance in court? Or is there anyway that we could just legally get the car back? |

Rep Power: 10 | | Re: sold a car and buyer wont pay If you think that she would lie in court and say that she paid you in full, in cash, than you probably don't have a chance as it would be her word against yours. If she admits she did not finish paying and she admits that you did have a verbal agreement to pay, but she didn't pay for some other reason, than the court should uphold the verbal agreement as a contract.... Ways she is likely to win in court: Claims she already paid you in full Claims the car was a gift Ways she is likely to loose in court: Claims she had a problem with the car sometime afterward. Claims she didn't really like the car as much as she thought she would. Claims the car isn't worth what you were asking.
