i went to an immigration lawyer about 4-5 months ago to see if they could do an adjustment of status for me. When i went they said their fee was $4000 plus the costs of the paperwork. They asked for a deposit of $2000, but I said all i could give them was $500 at the moment. They took it. They never specified how much of it was for the consultation and they didn't give me a receipt. (i wrote a check). My husband and I are going to be getting a divorce soon, so I won't be needing their help (at least not for the moment) so I explained to them and asked if I could get a refund. He now claims they charge $500 just to start a file and put it in their system. They never sent me a bill or even gave me a receipt, so am I just out of luck or is there something I can do?

If the lawyer did not give it back when asked, your out of luck.... At this point, totally at their discretion. Consultation is a reasonable claim - and fighting a lawyer over $500.00 is far from practical in my opinion..
