Rep Power: 0 | | What is the legal term for this situation? Ok.. So you are looking to buy a something, a good or service.
You are party A, the seller is party B.
Party B is selling a service or something. Be it a car, credit card reporting service, or a new big screen tv or lawn service, or accounting service. meaning they give you something, in exchange for something (usually money).
Party B makes promises.. helps you to obtain financing for the service or the item.
Only later do you find out that party B, did not tell you everything you needed to know, and that the item or service they sold you is defective and that they knew about it at the time. Now now not only do you have a problem with the seller (party b) but another party who was the lender for the fianancing, Party C.
Now Party B is no longer part of the picture. And party C is constantly harrasing you. You feel cheated by Party B. And you now find out that party B is no longer in business, has sold the business to another party, or has changed names, location, ect..
What is this situation called, and what recourse does party A have?
Thanks. |

Knowing what the item was and where it was obtained from would help, but to a certain extent I'm getting the feeling that "buyer beware" is in order.. Read your contracts.... Look at what you signed.. Most disputes will fall back on any written agreements you may have with the seller..
If it was a car, and you bought it from a licensed dealer, then you would generally have some recourse. If you bought a car from a private seller, things are a whole lot different. If you have financed something, the bank wants to get paid on the note extended to you. They are not concerned with your satisfaction in the product or service - only that it was delivered or provided based on your guarantee to make payment.
You can always go after a business for unethical business practices etc... But unless your case is of substantial evidence or proof of something, where is it going to get you.. Like I said, some more info would make it easier to answer... Disputes in business dealings or buyer and seller disputes can be very complicated.
