Rep Power: 0 | |  Credit Card Debt TRIAL?!
I recently received a summons concerning an old credit card debt back from when i was in college. The amount was $941 plus whatever fees. This is a company Liberty Credit that I guess purchased the account from Providian. I went to the first hearing and used a Statute of limitation defense. The debt was charged off in 2001 and that was the last activity. But because I did not know to send a copy of the answer also to the plantif they gave them a copy and said they could treat it as an informal answer, and set a date for another hearing for Trial Setting/Dismissal. The judge herself also said it was past the SOL in Missouri. I was unable to find transportation for the second hearing but sent a letter explaning that, apologizing, and asking that it be dismissed due to the the SOL. Now today i get notification of Trial date being set and a packet of papers from the plantifs lawyers full of questions to answer and have notarized! I have NO income and NO assets. I currently live with my BF whos only income is disability. I have no bank accounts, cars, posessions or anything! I am in panic and do not know what to do or expect at this TRIAL! can anyone help?!?!
