I have a question regarding "double Jeopardy". If someone is being charged with possession of stolen property ( wasn't in possession, was peeing in bushes and stolen property was buried somewhere around him) and the D.A. is relentless on pushing this ( its been a year) with his offer as of today being plead guilty to the charge, no prision, maximum 6 months in county with probation; my question, couldn't the D.A. charge him with the robbery also sense they would have a guilty plea for the property? The public defender said "no, they couldn't charge him with the robbery because it would be double jeopardy". I said that they were 2 seperate charges and the case is still being investigating, he said its double jeopardy. Is this true? |
