18 yr old is accused of giving his 14 yr old cousin a drug that immobilized her, and then raping her. He is given a court apptd lawyer. Pleads nolo condendere, and IS NOT sentenced to any prison time. He has maintained all along that he did not do it. He received some sort of probation. So, can anyone tell me what would induce a prosecutor/da and a judge to allow this? ty, oldbat

Which are you asking about, the sentance or the fact he didn't do it?

i am wondering why a prosecutor would allow this plea if he had evidence to convict and why a judge would sentence no prison time for it. while nolo isn't a guilty plea, don't the judges sentence as if it were? ty for your help. |
