Rep Power: 0 | | Family Court Nonsense Holding Up Move Hello,
About 3 months ago I cut my sister off from financially helping her due to her continue to live in the same "live off everyone" lifestyle. Within weeks of this she made allegations against my 13 year old son in regards to her 4 year old daughter. She went to family court and filed a family offense petition making up various accusations. So far she has managed to drag this out for 3 months by waiting till last minute to get a lawyer for herself (although the court had already appointed a lawyer for her daughter and my son) Now the next court date will not be untill the middle of september. We have been struggling financially for a while (another reason I cut off helping my sister) and have been offered a better job opportunity in Alabama. (We live in NY) I was wondering being this is a family court matter and is not any type of custody matter if anything would happen to my son or us if we followed through with our move before the case was closed. I hate to have to turn down better job opportunities for my husband and I and better opportunities for my children over a bunch of stuff my angry sister made up in her anger. Any advice would be appreciated. |

Rep Power: 10 | | Re: Family Court Nonsense Holding Up Move I would imagine it would depend on what those allegations are and how serious the crime, if any has been committed... If you move, expect to travel back to appear at any court dates that hit the calendar. Unless it's a serious matter, I wouldn't expect anything to really happen to him if you move, but you do need to appear. If it is frivolous, try to get whatever it is reduced to a violation (like a ticket) or completely thrown out to resolve it quickly at your next court date. Let them know your trying to move. But again, a lot depends on what those allegations are...
