Rep Power: 0 | | Cease & desist letter - $0.99 Ebay sale I sold a Betty Boop necklace for $0.99 on Ebay about six months ago. I received a letter the other day from a lawyers office saying that infridged on the their lincensed character by selling a counterfeit necklace. Attached to the letter was a copy of the ebay auction for the $0.99 necklace.
The letter stated that I had done irreparable harm to their company and they would prosecute me to the fullest extent if I did not call them with 5 days and give them the amount of money they have determined I owe them. There was also a case number, they said they filed suit and that was the only way to end the suit.
I bought the necklace in good faith from a very large costume jewelry wholesaler and had no idea it was not authentic (if that is true).
It does not seem right they can determine how much I owe them (if anything) without having a judge determine the case.
Do I need a lawyer? Can this be possible over a $0.99 auction?
I looked up the lawyer info, apperently she is registered with the CA Bar but I could not find and other info about her.
However, when I look up the district courts in her area they say the case number is not valid, it is not even the correct number of characters.
I am in VA could a case like this even merit me traveling 2,200 to decide on.
